Terms and Conditions of using notification service of account balance fluctuation

1. Definitions

  • Bank (VIB): Vietnam International Commercial Joint Stock Bank
  • Customer: Be individual or organization who registers to us its notification service of account balance fluctuation at VIB and VIB approves to render the service.
  • Notification service of account balance fluctuation (Service): Be service that VIB sends a notification to Customer when there is any change in balance of account with the content and type of transaction notified as regulated by VIB for all Customers using this service
  • Account: Be current account that has been successfully registered for the notification service of account balance fluctuation.
  • Deposits: Term deposits which are opened at Branches/Transaction offices or on VIB’s Internet Banking/ Mobile Banking (MyVIB).
  • Certificate of Deposit: Certificate of Deposit issued by VIB.

2. Subject for using service

Be individual or organization which are Micro Small and Medium Enterprises (MSME) as regulated by VIB from time to time, established and operate legally according to laws; and


Have a current account at VIB

3. Method of notification

Customer chooses the method(s) of receiving notification including:

  • SMS messages; and/ or
  • Messages on digital platforms (zalo/ viber/ other platforms as regulated by VIB from time to time); and/ or
  • Email; and/ or
  • VIB’s Internet Banking/ Mobile Banking (MyVIB).

4. Type of transaction notified

  • Customer chooses the below type of transactions that changes balance account:
    • All transactions incurred in the current account that changes account balance (Basic Package), or
    • Transactions incurred in the current account that changes in account balance from 500,000 VND/ Foreign currencies or more (Economy Package).
  • VIB does not send notification of account balance fluctuation for money transfers between Customer’s c accounts at VIB, deposit/ pay principal, interest of Deposits, Certificate of deposit into Customer’s account at VIB.

Once immediately after account balance fluctuation

6. Service fee

Announced and publicly listed by VIB from time to time on VIB’s website or at VIB’s transaction offices. Here, by this document, the Customer agrees to irrevocably authorize VIB to to automatically deduct these fees on Customer's account.


Service fee of the first month is collected immediately after the Customer has registered the service successfully and the following month(s) this fee is collected on the first day of  the month(“This Periodic collection day’). This periodic collection day is chosen by VIB but no later than 10th day of each month.


VIB reserves the right to change service fees from time to time that VIB deems appropriate ("Revised service fee"). VIB will notify customers by one of the following forms: (i) sending written notice or email or SMS to the address/email/sms registered with VIB or (ii) listed at VIB's transaction offices, or (iii) displaying, publicizing on VIB's website, or (iv) sending messages via the service system, or (v) by other means decided by VIB not contrary to law.


The Revised service fee will be effective from the date stated in VIB’s notice but no earlier than 10 days from VIB's notice date. If the Customer does not agree with this Revised service fee, the Customer can terminate the service within 10 days from VIB’s notice date. In case the Customer do not terminatethe Service, the Cutomer confirms and that: the Customer will be deemed to have accepted this Revised service fee.

7. Rights and responsibilities of the Customer

7.1 Rights of the Customer

  • To be provided with the Service by VIB in accordance with the Terms and Conditions for using notification service of account balance fluctuation (“this Terms and Conditions”).
  • To request VIB’s investigation when not receiving notification according to method of notification registered.
  • To request for changing Services information such as: account, phone number/email, method of notification, type of transaction notified, … or request for terminating the service.
  • Other rights according to this Terms and Conditions, provisions of laws or other written agreements between the Customer and VIB not contrary to the applicable law.

 

7.2 Responsibilities of the Customer

  • To comply with the provisions of the laws, VIB’s regulations on the using Services and documents fully, accurately and correctly for VIB. . The Customer is responsible for the completeness, truthfulness and legality of all information and documents provided to VIB.
  • To guarantee that the using service derive from the needs of the customer and the customer is fully responsible for those transactions.
  • The Customer need to notify VIB immediately when detecting errors, mistakes on notifications and there is any change in the service information registed. The Customer is solely responsible for damages and losses arising from the delayed notification of the Customer
  • Check and pay adequate fees related to the use of the service according to the fee tariff prescribed by VIB from time to time.
  • Other responsibilities in accordance with this Terms and Conditions and relevant provisions of law or other written agreements between the Customer and VIB not contrary to the applicable law

8. Rights and responsibilities of VIB

8.1 Rights of VIB

  • Have right to request Customer to provide fullly and accurately necessary information and documents when customer request to register and use the service.
  • To debit all of the Customer’s current accounts at VIB or require Customer to transfer the money to VIB to pay the service fee as prescribed in this Terms and Conditions.
  • Have right not to perform or delay in the implementation of agreements in this Terms and Conditions in case of malfunction of the processing system, transmission, or electrical system due to fault of the third party’s service provision or for any reason beyond the control of VIB or for the purpose of ensuring safety and limiting risks for the customer. In this case, the Customer agrees to bear all actual risks and damages incurred.
  • Have right not to perform commitments and obligations under this Terms and Conditions if the performance of such commitments or obligations leads to VIB's violation of law.
  • Have right to terminate the provision of Services to the Customer when VIB does not collect the service fee within 03 days or more from the date of fee collection or when the Customer violates this Term and Condition.
  • Other rights in accordance with this Terms and Conditions and relevant provisions of law or other written agreements between the Customer and VIB, not contrary to the applicable law.

 

8.2 Responsibilities of VIB

  • To comply with regulations on provison of services to customer in accordance with this Terms and Conditions, VIB's regulations and provisions of law. Instructing customers to strictly comply with the regulations on registration/ change to use the service and relevant regulations when using the service.
  • To provide fully and timely service and requirements related to using service in accordance with the regulations and agreements between VIB and the Customer.
  • Handling of investigation and claims of customers related to using service in accordance with this Terms and Conditions and the provisions of law.
  • Other responsibilities in accordance with this Terms and Conditions and relevant provisions of law or other written agreement between the Customer and VIB not contrary to the applicable law.

9. Change in content of terms and conditions

Hereby the Customer agrees that: VIB has the right to change the terms of this Terms and Conditions (‘The Revised Terms and Conditions”). VIB will send the notification by: (i) text of email or SMS message to contacts the Customer has registered at VIB, or (ii) listed at VIB’s transaction locations, or (iii) displayed and announced publicly on VIB’s website, or (iv) message in the service system of (v) other methods determined by VIB that obey the laws and regulations. The Revised Terms and Conditions will take effect from the date mentioned in VIB’s announcement but no sooner than 15 days since VIB’s announcement.


Here, Customer agrees that: VIB has right to change the terms of this Terms and Conditions (“Revised Terms and Conditions). VIB will notify customer by: (i) sending written notice or email or SMS to the address/ email/ sms registered with VIB or (ii) listed at VIB's transaction offices, or (iii) displaying, publicizing on VIB's website, or (iv) sending message via the service system or (v) by other means decided by VIB not contrary to law. The revised terms and conditions will take effect from the date stated in VIB's notice but no earlier than 15 days from VIB's notice date.


If the Customer does not agree with Revised Terms and Conditions, the Customer can terminate the using Service and all related offers and services at VIB within 15 days from the date of notice of VIB. In case the Customer does not terminate the using services at VIB, the Customer confirms and agrees that: the Customer will be deemed to have accepted Revised Terms and Conditions. The fact that the Customer continues to use service after the effective date of the Revised Terms and Conditions will be the final evidence that the Customer has accepted to be bound by these amendments.


The Customer is responsible for monitoring and updating the regulations, procedures and content about the service, Terms and Conditions; at the same time, maintaining facilities, tools and addresses to receive information notified by VIB.
