Terms and conditions for using mobile banking services - VIB checkout

1. VIB Checkout - Mobile banking services for Micro enterprises and business individuals

1.1VIB Checkout is a mobile banking application designed for Customers belonging to the segment of Micro enterprises and business individuals who have registered to use Mobile Banking services installed on mobile devices using iOS 12.0, Android 8.1 or higher operating systems. Accordingly, Customers can perform transactions with the Bank without going to VIB's branches and dealing rooms.

 

1.2Target customers using VIB Checkout: Include institutional and individual customers who meet the following conditions

  • Institutional customers are in the segment of Micro Enterprises (MSME) (including business households and other organizations) of the Retail Banking Division exploited in accordance with VIB's regulations from time to time and opened a current account at VIB.
  • Individual customers successfully register for iBusiness package (business individuals)

1.3Customer's User (User) is an individual registered by the Customer with VIB to authorize using of VIB Checkout with one or more roles as follows: Inputter, Approver, Cashier, Soft POS Admin, Super User

 

1.4Username: The User's username when using VIB Checkout

 

1.5Password: A sequence of secret characters sent by VIB to the User or created by the User in accordance with VIB's regulations to log in to VIB Checkout.

 

1.6Password for the first login: A sequence of characters sent to the phone number or email (or other forms according to VIB's regulations from time to time) of the User after the Customer has successfully registered the User to use VIB Checkout services with VIB. The User needs to change this password after the first login to continue using the services.

 

1.7Login PIN: A security number sequence consisting of 4 or 6 numbers created by the User to replace re-entering the username and password when logging into VIB Checkout from the second time onwards.

 

1.8Smart OTP authentication method: A security solution integrated in VIB Checkout whereby the system will automatically generate OTP code to authenticate money transfer, payment and other transactions according to VIB's regulations from time to time. 

 

1.9 Smart OTP PIN: A security number sequence established by the User to use when verifying transactions

 

1.10SMS OTP authentication method: A security solution in which User will receive a message containing OTP code sent to registered phone number.

 

1.11SMS OTP: A secret number sequence valid for one-time use because VIB's system is automatically randomly generated and sent to the registered phone number of the User by SMS in cases of activating Smart OTP, forgetting login information and other cases as prescribed by VIB from time to time. SMS OTP is valid for use within a certain time limit as prescribed by VIB.

 

1.12Transaction order is any request, direction, instruction, operation of the User created through the use of VIB Checkout.

 

1.13Mobile banking services provided by VIB to customers through VIB Checkout include:

(a) Information inquiry service: Query of information and transaction history of a current account.

(b) Fund transfer service: Internal fund transfer to accounts opened at VIB, interbank fund transfer via account number, 24/7 fast fund transfer, etc.

(c) Information inquiry service related to the bank's operations, including information related to ATM and branch addresses, promotions, exchange rate, interest rates, other information according to regulations of the Bank from time to time.

(d) Utility services: Change login password, change application PIN, biometric login with fingerprint or Face ID, change wallpaper, etc.

(e) Other useful features and services developed by VIB from time to time. 

 

1.14From time to time, VIB may decide to add, modify or terminate the provision of one or several types of services on VIB Checkout application. VIB will notify Customer on service login page and/or website and/or send notification to Customer via email, SMS and/or other communication channels at VIB's discretion.

 

1.15Electronic signature is a combination of security method for Customer to authenticate transactions when using VIB Checkout application, including (i) the User authentication when accessing VIB Checkout including username and password or login PIN, face ID, fingerprint, (ii) transaction authentication via Smart OTP PIN or SMS OTP and (iii) other forms of electronic authentication as regulated by VIB from time to time.
 

2. Rights and responsibilities of the Customer

2.1The Customer complies with the transaction process and service guidelines of VIB. Do not use the information and services provided by VIB for the purposes of violating the law or violating fine customs and traditions. 

 

2.2 The Customer is responsible for protecting and keeping account information confidential and fully responsible in case the username, password, login PIN, SMS OTP, Smart OTP PIN, face ID, fingerprint and other authentication measures prescribed by VIB from time to time are lost, misused, or disclosed to a third party, resulting in losses. Some protective measures are recommended such as: do not give information, mobile device to others; do not set simple password, login PIN, Smart OTP PIN, coincide with easily guessed information; do not allow mobile devices to automatically save password, login PIN, Smart OTP PIN; do not let others use the mobile device without exiting the VIB Checkout application screen. This provision is still valid even after the Customer stops or terminates services.

2.3Promptly notify the Bank when detecting errors or mistakes in his/her account.

 

2.4The Customer commits that the Customer is the User who has the right to use the registered mobile subscriber number, and is responsible in case there is a complaint arising from this subscriber information.

 

2.5The Customer accepts that any transaction order executed by the Customer or the User to access VIB Checkout by any authentication method specified in these Terms and Conditions and/or in combination with other authentication methods provided by VIB to the Customer to order transactions on VIB Checkout, these transaction orders are considered to be created by the Customer and the Customer must be responsible for the accuracy, truthfulness and legitimacy of these transaction orders.

 

2.6Data and information recorded on VIB Checkout, in any form, about the receipt and processing of the Customer or User's transaction orders as well as the content of these transaction orders are legal evidence that the Customer has used VIB's VIB Checkout and the Customer is responsible for transaction orders created by the Customer or the User, regardless of whether these data are not in writing or generated by VIB Checkout or the Customer has changed the information related to the transaction orders after the transaction orders have been processed by VIB.

 

2.7Agree to provide VIB with information related to the registration and use of VIB Checkout service in accordance with VIB's regulations, ensuring that all information provided to VIB is accurate, complete and up-to-date.

 

2.8The Customer can terminate the use of VIB Checkout at any time after completing necessary procedures in accordance with VIB's regulations.

 

2.9Agree to let VIB debit the account to pay the fee for using VIB Checkout (if any).

 

2.10Agree to receive messages and/or e-mails, notifications sent via VIB Checkout or other form of notification as determined by VIB to:

(a) Notify account balance changes in case the Customer registers to use services;

(b) Notify the username and password;

(c) Notify new products, services and promotions;

(d) Give other notices for performing electronic transactions with the Customer.

 

2.11Be responsible for resolving all disputes arising with the party instructing to credit the Customer or the beneficiary of the Customer in relation to money transfer after VIB has properly implemented the Customer's instructions.

 

2.12Notify or register with VIB as soon as there is a change in information related to Customer and User.

 

2.13Take other responsibilities under this regulation and relevant regulations of VIB and the law.

 

2.14Customer and User information is confidential when using VIB Checkout. For services related to third parties including: VIB, Customer and service and goods providers for Customer or VIB, Customers who agree to allow VIB to use Customer information to conduct tracing, data reconciliation, payment settlement and other purposes in order to provide VIB Checkout services to the Customer.
 

3. Rights and responsibilities of VIB

3.1VIB is exempted from responsibilities because VIB's service delivery system does not perform transactions at the request of the Customer in case the processing system, communication system, etc. has a problem or for any other reason. 

 

3.2VIB is exempted from responsibilities in case the Customer chooses the wrong credit account (account of the beneficiary).

 

3.3VIB has the right to refuse, suspend or terminate the provision of VIB Checkout services of the Customer at any time without prior notice as well as without the consent of the Customer in the following cases:

(a) VIB has suspicions related to forgery or risks when performing transactions.

(b) VIB suspects that a third party uses fraudulently, or tries to access and use VIB Checkout using the Customer's or User's account.

(c) According to the provisions of the law or at the request of the competent authorities as prescribed.

 

3.4VIB is responsible for notifying the Customer of the suspension or termination of services within 07 working days from the date when VIB stops providing services, except for the case specified in Clause 3.3, Article 3 above. 

 

3.5VIB ensures that the VIB Checkout system is stable, secure and conformable to the provisions of the law related to service provision.

 

3.6VIB is not responsible for any damage or loss incurred by the Customer, arising from or due to:

(a) The use of the service or access to information from the application by those who are or are not registered by the Customer with VIB, including whether the Customer, the User knowingly or inadvertently discloses to others using VIB Checkout account; or

(b) Interruption, delay, unavailability or any problem occurring during the service provision due to causes beyond VIB's reasonable control including but not limited to program interruption due to the program that needs to be upgraded or repaired, Internet service provider connection issues, third-party service provider’s actions; or

(c) Any force majeure including but not limited to natural disasters, strikes, riots or requests or directives of the Government and State agencies; or

(d) The Customer and/or User allows to be stolen or reveals his/her username, password, login PIN, face, fingerprint, SMS OTP, Smart OTP PIN and other authentication factors and methods; or

(e) The Customer uses software, documents or follow instructions not provided by VIB; or

(f) Any damage or loss of the Customer that is not due to VIB's willful fault.

3.7Do not take responsibilities for any disputes between the Customer and the beneficiary according to the Customer's instructions (if any).
 

4. Transaction limit

4.1Transaction limit of a current account: is the amount of money allowed to be transacted on VIB Checkout of each current account that the Customer has registered with VIB. In case of not registering, Customer will not be able to make transactions on VIB Checkout

 

4.2Maximum approval limit/transaction: is the maximum amount of a transaction that a user with the approval role is allowed to approve on VIB Checkout registered by the Customer with VIB. 

 

4.3The maximum approval limit/transaction and transaction limit of the current account registered by the Customer but must not exceed the limit prescribed by VIB from time to time.

 

4.4VIB may change and/or set limits for transactions from time to time and will be announced at VIB's branches/transaction offices throughout the system or on VIB's official website.

5. Transaction performance

5.1VIB is understood to have received transaction orders executed by the Customer through the use of VIB Checkout when and only when these transaction orders have been executed according to VIB's instructions and have been recorded by VIB’s system.

 

5.2Transaction orders created and approved on VIB Checkout after entering correct username and password or login PIN, fingerprint, face and verifying transactions by PIN Smart OTP, SMS OTP shall be deemed valid and binding on the Customer. VIB is not responsible for applying any form of checking other than checking the authenticity of Customer authentication measures and transaction authentication measures listed in this Clause.

 

5.3Transaction time: The User can make money transfer and payment transactions on VIB Checkout at any time.

 

5.4Transactions made on VIB Checkout must be made with accurate and complete information in accordance with VIB's regulations.

 

5.5Customer's transaction will not be processed successfully by VIB if:

(a) Account balance is insufficient.

(b) Transactions exceed the permissible registration limit.

(c) Information and documents are not provided sufficiently or information and documents that are provided do not meet the requirements for each type of transaction.

(d) Transactions are restricted or prohibited by law.
 

6. Service fees

6.1Applying and collecting fees from the Customer using VIB Checkout must follow VIB's fee regulations from time to time;

 

6.2Information on VIB Checkout fees and fee schedule are publicly listed by VIB at its headquarters/branches/transaction offices; on VIB’s official website; and on VIB Checkout service delivery channels or giving notice to the Customer via email;

 

6.3Fees will be collected as prescribed by VIB from time to time.

7. Irrevocable transactions

7.1The Customer cannot cancel, change, deny or repudiate any transactions performed on VIB Checkout as prescribed in Article 5. In case the Customer wishes to cancel his/her transaction request, VIB will only consider it upon condition that:

(a) The Customer sends a hard copy of the request to cancel the transaction to VIB, and 

(b) VIB has not recorded and/or processed transactions on its system at the request of the Customer, and

(c) The transaction cancellation does not affect the interests of VIB as well as the interests of any other third party.

 

7.2Any transaction that has been performed will be considered valid and irrevocable by VIB. Transactions undertaken and approved by the Customer are the ones performed by the Customer, VIB does not accept any authorization for any other third party to transact.

8. Governing Law and Dispute Resolution

8.1These terms and conditions are governed by the laws of Vietnam

 

8.2The two parties commit to strictly implement these “Terms and Conditions for using mobile banking services” and their amendments and supplements (if any). In case of any dispute arising during the implementation process, the two parties will jointly resolve it through negotiation. In case of negotiation failure, either party has the right to bring the dispute before the competent People's Court for resolution.

9. Notice of change

9.1The Customer agrees that any change in the “Terms and conditions for using mobile banking services” and the terms and conditions for using other services are publicly notified by VIB in one of the following forms:

(a) Posted on VIB's website, or

(b) Publicly listed at VIB's transaction points, or

(c) Send to the address registered by the Customer with VIB o

(d) Send to an email via the email address registered by the Customer with VIB or

(e) Other forms decided by VIB.

 

9.2Within 07 days from the date of public announcement by VIB, if the Customer has no written objection to VIB about the amendments and supplements to the “Terms and conditions for using mobile banking services”, it is understood that the Customer agrees to such amendments and supplements. 

 

9.3In case one or some provisions of the terms and conditions are no longer valid, the remaining provisions will still be valid.

 

9.4The Customer is responsible for monitoring and updating the regulations and procedures on the content of the services and these Terms and Conditions; at the same time maintain the means, tools, and addresses to receive information announced by VIB.
 

10. Changing, suspending and terminating the service

10.1For objective reasons, VIB has the right to suspend or terminate services that are being provided. In such cases, VIB will give notice on the website, on the mass media or to each Customer.

 

10.2VIB has the right (but is not obliged) to terminate or refuse or delay the transaction for any reason without prior notice including but not limited to the following cases:

(a) The Customer and/or User violates VIB's regulations or the law

(b) According to a decision or request of the Law or a competent state agency

(c) Suspected cases of VIB related to forgery or risks when performing transactions

(d) When the interests of VIB or the Customer or a related third parties may be harmed or fraudulent

(e) The Customer and/or User fails to comply with potentially risky services or security requirements as recommended by the relevant organization. VIB suspects that transactions are related to crime, money laundering, law violations or to implement anti-money laundering policies according to VIB's regulations and laws, and force majeure cases as prescribed by law.

(f) The User logs in with wrong username or password, login PIN, fingerprint, face, Smart OTP PIN, SMS OTP more than 5 times

(g) Other cases prescribed by VIB from time to time.

 

10.3 When VIB introduces newly added services, VIB may provide new services under additional terms which will be notified to the Customer from time to time in accordance with these terms.

 

10.4 In case the service which is being used by the Customer is terminated for any reason, this will not affect the transaction orders that the Customer has made previously.

11. Effect

11.1 These Terms and Conditions are effective from the time when the Customer uses VIB Checkout until the Customer terminates the service, except for the terms that are still valid under these Conditions and Terms.

 

11.2 The Customer confirms that he/she has read, understood, agreed, undertaken and complied fully with the terms and conditions for using VIB Checkout as well as other related agreements with VIB.
